DOH Updates Equity Transfer Request Process

(June 10, 2025) On June 3, 2025, the Department of Health (DOH) circulated a Dear Administrator Letter (DAL) notifying nursing homes that all email communications related to equity withdrawal requests including but not limited to inquiries, submissions, and supporting documentation must be directed exclusively to the newly established email address NF-EquityWithdrawal@health.ny.gov. DOH will no longer be utilizing the “NFRates” email address for communications related to equity transfers or withdrawals. The stated reason is to ensure that all requests are processed efficiently and without delay.

While this is an issue of concern primarily for for-profit organizations, members may be impacted by this policy if seeking to transfer funds from a foundation. This long-standing policy requires providers to seek DOH approval if they wish to withdraw equity or transfer funds that exceed 3 percent of annual patient revenue.
