Nursing Home Staffing Responses Due Oct. 9th

(Oct. 7, 2025) Thurs., Oct. 9th is the deadline for nursing home providers to respond to staffing standard compliance notices issued on Sept. 25th (i.e., 10 business days from the date of the letter). The Department of Health (DOH) posted nursing home staffing compliance letters covering the fourth quarter (Q4) of Calendar Year 2023 on the Health Commerce System (HCS) on Sept. 25th, meaning that members deemed to be out of compliance have until Oct. 9th to submit reconsideration or penalty reduction requests. Providers deemed compliant need not take any further action.

The letters were posted to the Health Commerce Document Management System (HCDMS) section of the HCS and can be accessed by individuals assigned to the roles of Administrator, Backup Administrator, Operator, and Backup Operator.

Facilities deemed non-compliant should first verify whether they agree with the Department’s calculations. If a facility identifies any errors that may have been made in that quarter’s submission of Payroll-Based Journal (PBJ) data or disagrees with the DOH calculations, it should submit a redetermination request using the dedicated website here. Note that the request must be completed online and should be accompanied by a spreadsheet detailing the correct information in the format proscribed by DOH.

Facilities that agree with the determination of non-compliance may request a penalty reduction by completing the online penalty reduction application here.
