Nursing Home Staffing Compliance Requests Due Nov. 26th

(Nov. 19, 2024) The Department of Health (DOH) posted nursing home minimum staffing compliance letters for the second quarter of 2023 on the Health Commerce System (HCS) last Tues., Nov. 12th. Providers have 10 business days from the date of the letter to submit redetermination or penalty reduction requests.

We recommend that members review the hours-per-resident-day figures that the State calculated as a first step. These are quarterly average figures that appear on the compliance letter and are calculated to one decimal place. If calculation or reporting discrepancies are identified, the facility would want to complete a redetermination request, which requires submission of the correct data in a format specified by the Department.

A facility that is deemed to be out of compliance but identifies no data discrepancies would likely benefit by submitting a penalty reduction request. Note that there are two distinct online forms: one for reconsiderations, the other for penalty reduction requests. Both links are provided on the compliance letter.
