Minor Change Made to DOH Nursing Home Staffing FAQs

(June 18, 2024) The Department of Health (DOH) has posted minor changes to the penalty section of the nursing home minimum staffing Frequently Asked Questions (FAQs). The changes include:

  • reducing the maximum penalty slightly for facilities in their fourth quarter of non-compliance that have staffing between 2.49 and 3.49 hours per resident day (HPRD) and between 2.2 and 2.89 HPRD; and
  • increasing the penalties slightly for facilities in their second, third, and fourth quarters of non-compliance that have staffing between 1.4 and 2.19 HPRD.

The FAQ document, which indicates that it was last updated on March 8, 2024, is available here. The Department announced in an association meeting earlier this month that it would be updating the FAQs and has confirmed that the document dated March 8th is the updated document.
