Universal Settlement Vote Overwhelmingly Positive
At the time of the latest count, approximately 97 percent of all current nursing home operators voted in favor of the proposed universal settlement of rate appeals and litigation. Most recently, LeadingAge NY and others worked with the State to verify the circumstances of the less than twenty facilities that either voted no to the settlement or have not yet voted.
The State is expected to make a final decision in the next few days as to whether “universality” has been achieved for purposes of moving forward in the next steps in the process. If the State plans to move forward, the actual settlement agreement and release forms will need to be drafted and finalized, and facilities will need to identify and forward information on rate appeals and lawsuits they have outstanding, which they believe would be excluded from the settlement.
In the meantime, we urge all nursing home members to continue to inventory their outstanding appeals and litigation for those claims that may be excluded under the Universal Settlement Term Sheet approved by the State. LeadingAge NY remains very involved in universal settlement discussions, and will keep members posted on any new developments.
