Universal Settlement Payments En Route
Most members should receive the fourth payment of the Universal Settlement of Appeals and Litigation by United Parcel Service (UPS) this week. The designated Trustee law firm that processes Settlement payments for most non-profit and public homes, Hinman Straub, issued checks that LeadingAge NY sent out early this week. The Department of Health (DOH) offsets any outstanding Medicaid liabilities from the payment, and for affected providers, this will be indicated on the remittance advice accompanying the check. Please note that in addition to the formulaic payments, some Settlement payments are attributable to specific lawsuits, and most such payments will be made to the home directly by the law firm that represented the facility in the litigation.
In the Settlement, nearly all nursing homes in the state agreed to settle most outstanding rate appeals and legal challenges in exchange for payments totaling $850 million over the course of five years. This is the fourth of five equal Settlement installment payments, with the final installment payable on or before March 31, 2020. Funding for the Special Appeals Fund of the Universal Settlement is expected to be distributed shortly, and those homes that qualified for the funding will be contacted directly by the Trustee law firm.
