Universal Settlement Payment Coming in July
Based on agreement between the state and nursing home providers the second annual payment from the Universal Settlement of Appeals and Litigation (US) must be transferred to the US trustees' attorneys by July 1, 2016. The state has indicated that the transfer will be made late this week. Hinman Straub, the trustee for most not-for-profit homes, and LeadingAge NY are poised to distribute checks next week. Providers should expect to receive them in the second week of July.
Consistent with how the first payments were made, settlement payments related to specific litigation will be made to the attorney of record for the specific litigation, who will distribute funds to individual homes. Funding unrelated to specific litigation will be distributed directly to the home. Homes with outstanding Medicaid liabilities will have those liabilities offset from US payments.
Except for those cases where alternative arrangements have been made, the payments to LeadingAge NY members will be distributed in the same manner and to the same address as the previous distribution, with the exception that organizations with multiple homes will receive a single mailing.
