DOH Extends Deadline for Homes to Request Audit Discontinuations

The State has agreed to extend the deadline for the submission of OMIG audit discontinuation requests until at least April 20, 2015.  Members are reminded that they should notify DOH of any OMIG audit currently in process that is yet to be finalized that they believe should be discontinued because the subject of the audit is an issue that is included in the Universal Settlement. Failure to identify such audits could result in the continued processing or finalization of such audits and recoupment even if those audits would otherwise be eligible for discontinuance under the terms of the Settlement.

Similarly, members should notify DOH if they have pending hearing requests related to OMIG audits of issues that are excluded from the Settlement.  Identifying these hearing requests will help ensure that they continue.   

Homes should submit this information in the body of an email titled “Audit Discontinuation” or "Excluded Hearing" to Richard J. Zahnleuter, director, Bureau of Litigation in the DOH Division of Legal Affairs at richard.zahnleuter@health.ny.gov.  OMIG has suspended pending audits through April 24, 2015, such that no new final audit reports will be issued in the interim. 

In addition, if there are any homes that have still not submitted a list of open appeals and litigation that should be excluded from the Universal Settlement, should do so as soon as possible.
