Employee Retention Credit Learning Opportunity
Members interested in the Employee Retention Credit (ERC), especially those who have filed applications, can take advantage of the opportunity to better understand the Internal Revenue Service (IRS) claim evaluation and recission process and gain insights on navigating the complexities of this ever-evolving program. A LeadingAge National webinar titled The Next Phase of the Employee Retention Credit: The IRS Audit will bring together experts from FORVIS, CliftonLarsonAllen, and Venable Law Firm to discuss the program and provide examples of organizations that have successfully gone through the audit process. The webinar will be held on Dec. 14th from 2-3:30 p.m., costs $109 for LeadingAge members, and requires advance registration here.
In a related development, the latest release of ERC claim notices from the IRS clarifies that employers cannot use Occupational Safety and Health Administration (OSHA) COVID-era guidance to qualify for an ERC claim. A General Legal Advisory Memorandum (GLAM) specifies that “[t]he OSHA communications explicitly do not command or mandate any employer to take any specific action, leaving it outside the ordinary meaning of the term 'orders.'” More IRS information about ERC eligibility is here; the “government orders” test for qualifying for the credit is discussed here.
