Nursing home cash receipts assessment amnesty

Homes that owe cash receipts assessment payments for months prior to January 1, 2009 have a chance to avoid penalties and interest on these payment if they remit them on or before December 1, 2010.  To take advantage of this opportunity, submit a letter indicating your home’s interest in participating in the amnesty and stating the expected payment date.  The address where to send the letter, along with other information regarding the amnesty program, is provided in a recent Dear Administrator letter (DAL) that is available by clicking on the Attachment 1 link below.

Please note that the amnesty does not apply to any payments, interest or penalties already paid nor to payments due from audit findings.  The amnesty provision, which was enacted as part of this year’s state budget, also specifies that it does not apply to assessment payment recoupments implemented through offsets applied to retroactive lump sum payments.

The DOH contact for amnesty questions is Roland Guiltz, 518-473-4653.  NYAHSA is seeking several clarifications from DOH and will issue additional guidance on the assessment amnesty shortly.
