New Resource: HOTMA Implementation Checklist and Sample Language

LeadingAge and DeSilva Housing Group have developed a “Mission-Driven HOTMA Implementation Discretionary Checklist” with suggested approaches and sample language for discretionary updates to Tenant Selection Plans.

While the Housing Opportunity Through Modernization Act (HOTMA) requires many mandatory updates to U.S. Department of Housing and Urban Development (HUD)-assisted Multifamily Housing property policies, communities are given critical discretion on certain implementation decisions. Many of these discretionary areas impact older adult residents.

LeadingAge urges members to implement HOTMA in ways that retain housing stability for residents and that are financially beneficial for older adult residents with low incomes. It also urges communities to adopt options that streamline housing processes, providing relief to both housing staff and residents.

Additionally, on Feb. 21st, LeadingAge coordinated a sign-on letter to HUD, urging the agency to delay requirements for housing providers to update their Tenant Selection Plans from March 31st to May 31st.

Noting that a new interim deadline of May 31st would still allow providers ample time to make any needed corrections or adjustments before the full compliance date, the letter argues that delaying until the end of May would, importantly, give providers enough time to understand the new asset limit enforcement options, to update policies in a way that best serves the community’s residents, and to more clearly communicate with residents about the property’s HOTMA implementation decisions and impacts.

The National Leased Housing Association, the National Housing Law Project, the National Affordable Housing Management Association, and Stewards for Affordable Housing for the Future joined the letter.
