LeadingAge Analysis Available: HUD's Reissued HOTMA Implementation Guidance

Following strong advocacy by LeadingAge, the U.S. Department of Housing and Urban Development (HUD) reissued implementation guidance for the Housing Opportunity Through Modernization Act (HOTMA) on Feb. 2nd. The updated guidance allows for owners to adopt a total non-enforcement policy of the new HOTMA asset limitations for residents already served at HUD’s assisted properties, either now or in the future.

HUD’s reissued Notice H 2023-10 also makes technical corrections and provides necessary clarifications. The implementation timeline is unchanged.
