HUD Proposes Eviction Notification Requirements for Non-Payment of Rent

On Dec. 1st, the U.S. Department of Housing and Urban Development (HUD) proposed a new rule requiring 30-day notifications to HUD-assisted residents prior to lease terminations for non-payment of rent. The proposed rule formalizes a practice currently in place as a result of a temporary policy related to the public health emergency.

Under the proposed rule, when tenants who reside in public housing or in properties receiving project-based rental assistance (PBRA) are facing eviction for non-payment of rent, the housing provider would need to provide those tenants with written notification at least 30 days prior to the commencement of a formal judicial eviction proceeding for lease termination. According to a HUD press release, the proposed rule would affect an estimated 3.9 million people, with 2.2 million of those residing in PBRA programs.

HUD is accepting comments on the proposed rule until Jan. 30, 2024. LeadingAge supports eviction prevention efforts and will work with members to develop constructive feedback for the agency, including relating to the appropriateness of a 30-day notification window.
