HUD PBCA Contract in Flux Again
The Governmental Accountability Office (GAO) has come out against HUD in its decision about
the Project Based Contract Administration (PBCA) protests regarding HUD’s rebid of the 42
state contracts. The GOA stated that HUD’s use of a Notice of Funding Available (NOFA), which
provides agreements to Public Housing Agencies (PHA) for the administration of the Housing
Assistance Payment (HAP) contracts, is improper because HUD is seeking contract
administration services that must be solicited through a procurement instrument that results in
the award of contracts.
This is the second reversal of the HUD process of rebidding of the PBCA contract which has
oversight for many HUD Section 202, 236 and other senior housing projects. Speculation is that
HUD will have to rebid (again) the entire 42 states, including New York, resulting in one or a
series of extended contracts with existing PBCAs, as those in the 42 states in question are
operating under initial extensions set to expire at the end of November.
