USCIS has issued updated instructions for employers of Haitian immigrants with TPS, in response to a recent court decision. The Trump administration has appealed, and 18 states have filed an amicus brief in support of the plaintiffs.

Despite the delay, these factors are still applicable to Utility Allowance adjustments effective Feb. 11, 2026 and later.

The law includes conscience exemptions and takes effect in August.
