New OSHA Reporting Requirement Affects Many Long Term Care Providers
A new Occupational Safety and Health Administration (OSHA) regulation took effect on Jan. 1, 2024, requiring high-hazard employers (including nursing homes, assisted living facilities, and other health and residential facilities) with 100 or more employees to submit electronic illness and injury data by March 2nd of each year. The new regulation expands upon the scope of the information that must be submitted electronically to OSHA pertaining to work-related injuries and illnesses and the facilities that must submit such information.
Currently, facilities that meet certain criteria must submit Form 300A (Annual Summary of Work-Related Injuries and Illnesses) to OSHA annually. This new requirement does not alter the existing Form 300A requirement. However, it creates a new requirement to submit information from Form 300A to OSHA for all establishments with 250 or more employees in covered industries and establishments with 20-249 employees in high-hazard industries. These high-hazard industries include, among others, hospitals, ambulatory care facilities, nursing facilities, continuing care communities, assisted living facilities, and other residential facilities.
The data must be electronically submitted through OSHA’s Injury Tracking Application (ITA). Most of the data submitted under this new regulation will be made public. Identifying information about workers will not be disclosed.
