Income thresholds for executive and administrative employees set to increase.

LeadingAge NY submits comments to the NYS Department of Labor on the proposed Overtime Exemption Rule.

The decision blocks implementation of the new federal rule that would have raised the minimum compensation level necessary to exempt an employee from overtime pay requirements.

The salary threshold for an executive, administrative or professional employee to qualify for an exemption from overtime pay will increase from $455 per week to $913 per week ($47,476 for a full-year worker) as of Dec. 1, 2016.

Effective Jan. 1, 2016, employers with more than 20 full-time employees working in New York City must offer them the opportunity to use pre-tax earnings to purchase qualified transportation fringe benefits.
