LeadingAge NY Submits Comments on Regulatory Reform to CMS
(June 17, 2025) In response to a solicitation by the Trump administration, LeadingAge NY and LeadingAge National have submitted recommendations for regulatory reforms pertaining to Medicare and its Requirements of Participation. LeadingAge NY called for dozens of regulatory changes that would eliminate duplication, improve efficiency, enable more person-centered care, and improve the quality of life of nursing home residents. Although LeadingAge NY's comments focused on nursing home regulations, LeadingAge National submitted comments on regulations governing home health, hospice, Programs of All-Inclusive Care for the Elderly (PACE programs), and Medicare Advantage, as well as nursing homes. It also took this opportunity to submit regulatory reform recommendations to the U.S. Department of Housing and Urban Development (HUD).
LeadingAge NY's submission called for a variety of reforms, including waivers of the three-day hospital stay requirement for Medicare coverage of nursing home services, limits to the scope of enhanced barrier precautions requirements, elimination of duplicative civil monetary penalties, expanded use of waivers of nurse aide training program suspensions, elimination of discharge notice requirements for resident-initiated discharges, revocation of the federal staffing mandates, simplification of the Form 855A off-cycle enrollment revalidation, and focusing of survey resources on low-performing facilities instead of those with high Centers for Medicare and Medicaid Services (CMS) star ratings, among others.
LeadingAge NY previously submitted comments in response to the federal Office of Management and Budget (OMB) solicitation and will be submitting comments in response to the U.S. Department of Health and Human Services (HHS) solicitation.
