DataPoint: PBJ Member Tool
(Sept. 2, 2025) The LeadingAge NY Payroll-Based Journal (PBJ) member tool has been updated to reflect staffing data for the first quarter of 2025. Section 2895-b of the Public Health Law and Department of Health (DOH) regulations at 10 NY Codes, Rules, and Regulations (NYCRR) §415.13 require a total of 3.5 hours of nurse staffing per resident per day in nursing homes, of which at least 1.1 hours must be provided by Registered Nurses (RNs) or Licensed Practical Nurses (LPNs) and at least 2.2 hours provided by Aides. The PBJ member tool enables users to ascertain whether their facility complied with these mandates during the observed quarter and calculates daily shortfalls for those interested in enacting staffing changes. A facility is deemed to be in compliance if its quarterly average staffing meets all three requirements based on PBJ data for the quarter. Hours per resident per day are calculated using facility-submitted PBJ data and the facility’s average daily census calculated by the Centers for Medicare and Medicaid Services (CMS) using Minimum Data Set (MDS) assessment data. On a statewide basis for the first quarter of 2025, without regard for sponsorship, 65% of facilities were deemed non-compliant. Seventy-five percent of for-profit homes were non-compliant, along with 49% of not-for-profit homes and 23% of public homes. Since LeadingAge NY started tracking compliance in the fourth quarter of 2021, this has been the lowest rate of non-compliance for not-for-profit homes.
