The FAQs include a chart describing progressive penalties based on the gap between the facility's staffing and the overall 3.5 nursing hours per resident day and the number of quarters out of compliance. Progressive penalties may be fully or partially reduced based on mitigating factors.

The case mix adjustment in January 2024 operating rates will be based on assessments with reference dates spanning April 1^st through Sept. 30, 2023. Spurred by federal changes in the MDS, the freeze will remain in effect while the State adopts a PDPM-like acuity adjustment.
