CMS Issues Guidance Outlining the Use of Civil Money Penalties

In an effort to achieve greater consistency, CMS has issued guidance and an analytic tool to assist in the imposition and calculation of Civil Money Penalities (CMPs).  In determining whether a CMP or any other penalty is warranted, CMS takes into account the scope and severity of the deficiency, the relationship of one deficiency to another that resulted in non-compliance, the facility's history of non-compliance and the likelihood that the selected remedy will achieve compliance.  The CMS letter and analytic tool may be viewed here.
