Civil Money Penalties to Increase

Effective Sept. 6, 2016, Civil Money Penalties (CMPs) imposed for non-compliance with nursing homes regulations are increasing substantially. The new penalties are being implemented under the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015, which adjusts the penalties to reflect inflation and to “maintain their deterrent effect.”

The adjustments will raise the maximum penalty for out-of-compliance skilled nursing facilities from $10,000 per day to $20,628.

The rule will also include penalties for individuals who notify skilled nursing facilities when a survey is going to be conducted, as well as for improper billing and instances of a skilled nursing facility failing to meet certification requirements.
