DOH Issues New Wage Parity Compliance Certification Requirements
In an eMedNY communication issued on May 11th, the Department of Health (DOH) provides guidance on new requirements for plans and providers who need to certify compliance with wage parity provisions. These provisions apply to downstate areas only. The guidance specifies that by May 31, 2021 (although elsewhere it seems to suggest June 1st) and annually thereafter, all Medicaid Managed Care Organizations (MCOs), including Managed Long Term Care (MLTC) plans, as well as Certified Home Health Agencies (CHHAs), Long Term Home Health Care Programs (LTHHCPs), Licensed Home Care Services Agencies (LHCSAs), and Fiscal Intermediaries (FIs) must submit to the Department, electronically through the eMedNY Provider Portal, a certification of compliance with the updated wage parity requirements.
The new guidance includes a requirement that the certifications be made electronically and that an additional certification be filed with the Department of Labor (DOL). It also specifies penalties for organizations that willfully pay less than the wages mandated by the wage parity provisions. The guidance is available here.
