NYS Working to Amend LIHTC QAPs and SLIHC Regulations

(July 30, 2024) In an effort to improve the administration of the federal Low-Income Housing Tax Credit (LIHTC) programs and the State Low-Income Housing Tax Credit (SLIHC) program, the NYS Division of Housing and Community Renewal (DHCR) is working to amend its Qualified Allocation Plans (QAPs) and regulations in the coming months.

LeadingAge NY staff were invited to join a limited number of subsidized housing developers and advocates in the first step of the adoption process by participating in a virtual roundtable discussion with DHCR officials to review the changes being considered by the agency and the anticipated timeline of the updates on July 8th.

The agency anticipates issuing a Notice of Proposed Rulemaking and its specific changes in the State Register, triggering a public comment period, in the fall of 2024. The public comment period would conclude, following at least one public hearing, in early 2025, which would allow for the final amendments to be adopted by the summer of 2025. LeadingAge NY staff will continue to monitor, and will work to represent member interests throughout, the amendment process.

To prepare for the public comment period, LeadingAge NY has begun soliciting feedback from subsidized housing provider and developer members and other stakeholders on the QAPs and, more specifically, on the ways the State’s processes for awarding the credits support or impede the development of housing affordable to and appropriate for the growing population of low-income older New Yorkers.
