Reminder: Safe Discharge Plans

In the latest Medicaid Update, the Department of Health (DOH) reminds home care providers that when an individual is transferring from Fee-for-Service (FFS) to any Managed Care Plan, home care providers need to adhere to the regulations for a safe discharge. The regulations regarding a safe discharge of services are found in 10 NYCRR 766.2, titled "Patient service policies and procedures." Note 10 NYCRR 766.2 (a)(8) and (9). The regulations state that “home care agencies may not stop providing services during the transition from FFS Medicaid to a Managed Care plan.”

The notice includes that this applies to patients enrolling in any of the state's Managed Care programs.
