LeadingAge NY Comments on Proposed Regulation to Allow LPNs to Assess Need for Personal Care and CDPAP Under NYIA
(March 31, 2026) LeadingAge NY provided public comment on a regulation proposed by the Department of Health (DOH) that would allow Licensed Practical Nurses (LPNs) to join Registered Nurses (RNs) in carrying out assessments for individuals seeking personal care and Consumer Directed Personal Assistance Program (CDPAP) services. The Department is seeking to add LPNs to the assessment process due to NY Independent Assessor (NYIA) workforce shortages.
LeadingAge NY cited a number of sources that state that the current LPN scope of practice does not provide for this task. We also emphasized that such a piecemeal approach for the State's purposes should be looked at more holistically. Such a change could impact health care provider access to LPNs in long-term care and other settings.
