Input needed on draft contracts for Care Management Administrative Services - October 2012
We are pleased to report that DOH has shared draft contracts specifically developed to provide Managed Long Term Care Plans (MLTCPs) with a standardized process to enter into agreements with entities, such as LTHHCPs, for the provision of Care Management Administrative Services (CMAS). We have been persistently advocating for this, and DOH has asked for our feedback, though we must provide comments by the morning of Friday, Oct. 12.
According to DOH, the CMAS Agreement Guidelines and Standard Clauses allow MLTCPs to establish a relationship in a more streamlined fashion, and avoid the additional requirements and reviews associated with a Management Services Agreement (MSA). The processes and submission requirements are similar to existing Provider Contract and MSA Guidelines, which MLTCPs are familiar with. Additionally, DOH reports that there are no changes to the contractual requirements for delegation of any management function as defined in Part 98-1.11.

We have been advocating that the MSA not be used for CMAS for numerous reasons, including the sole entity clause. We have requested an extension to the deadline to carefully review the documents.
