FAQs on Physician Orders for LHCSAs

The Department of Health posted to HCS DAL:DHCBS 14-02, which clarifies the regulatory requirements for physician orders when a Licensed Home Care Services Agency (LHCSA) is under contract with a Managed Care Organization (MCO) or a Managed Long Term Care Plan (MLTCP). This further clarifies the first DAL:HCBS 13-15 on this topic, which was issued on July 8, 2013.

The nine questions cover the regulations to follow, who is responsible for securing the orders, copies of the physician orders, changes with the physician orders and the instance if an MCO or MLTCP has more than one provider to provide personal care services to the same patient.

LeadingAge New York continues to seek clarification and regualtory relief on the numerous home care regulations as we move into managed care. Regulatory relief and clarification of regulations have been and continue to be a cornerstone of our advocacy efforts and outreach to the Home and Community-Based Care Work Group that was formed as a result of last year's budget.
