Update for NHTD/TBI Waiver Providers

NHTD/TBI Cost Reporting 

Providers in the Nursing Home Transition and Diversion (NHTD) and/or Traumatic Brain Injury (TBI) waiver programs must complete their 2022 Cost Reports by Oct. 31, 2023. As previously reported, the State Department of Health (DOH) had extended the deadline in order to formally solicit feedback and gather provider questions. 

DOH has compiled an FAQ document to assist providers in their 2022 Cost Reporting. Some providers may have already submitted their Cost Reports. After reviewing the FAQ resource, agencies may resubmit the report if they feel revisions are necessary. The Cost Report Manual and Excel spreadsheets on DOH site is under the Cost Reporting section. 

Annual Cost Report submissions to the Department are mandatory for these participating providers. Failure to file may result in financial penalties. 

 

HCBS Conflict of Interest Rule

As members know, DOH provided an extensive webinar and Q&A recently on NHTD/TBI compliance with the federal HCBS Rule regarding Conflict of Interest provisions.  Please see more on that here.

In a recent update by the Department, it notes that it has requested from CMS an extension of the Nov. 11th deadline to March 1, 2024. The extension has not yet been granted, but DOH states that CMS seems supportive of the extension.

DOH also conveyed there is no official FAQ for COI provisions because it is working with CMS to ensure a uniform understanding of the policy. They will send out a notice when the extension is approved.
