DOH Issued an ADM on Personal Care and the Consumer Directed Personal Assistance Program

DOH issued an Administrative Directive (ADM) on the changes to the  Personal Care Services Program (PCSP) and Consumer Directed Personal Assistance Program (CDPAP), as a result of MRT # 4652. The regulatory changes include the following:

  • Limiting PCSP and CDPAP nutritional and environmental support to eight hours per week for Medicaid recipients who only receive nutritional and environmental supports;
  • Defining continuous personal care services and continuous consumer directed personal assistance as 16 hours or more instead of 24 hours;
  • Defining total assistance;
  • Defining live-in 24 hour personal care and CDPAP, which also includes an evaluation of whether the recipient's home has an adequate sleeping accommodation for a live-in aide;
  • Expanding the role of the local professional director; and
  • Promoting the efficient use of resources that includes adaptive or specialized equipment/supplies and the availability of informal and formal supports.

On page six of the April 18 NYS Register, emergency rules to amend sections 505.14 and 505.28 of Title 18 NYCRR are outlined regarding the ADM on PCSP and CDPAP.
