State Posts HCBS Rule Compliance Roles and Responsibilities for Social Adult Day Care Programs

(July 30, 2024) The NYS Department of Health (DOH) has introduced a new webpage, Social Adult Day Care (SADC) Home and Community-Based Services (HCBS) Compliance Review: Roles and Responsibilities, now available on the DOH SADC HCBS Compliance website. This webpage is a resource for Managed Long Term Care (MLTC) plans and SADC sites which outlines the HCBS Compliance Review process and the responsibilities of MLTC plans, SADC sites, and DOH within each phase of the process.

To access the new webpage from the SADC HCBS Compliance website homepage:

  • Navigate to the ‘For MLTC Plans’ or ‘For SADC Sites’ section.
  • Click the ‘SADC HCBS Compliance Review: Roles and Responsibilities’ link.

Various steps in the Compliance Review process are listed:

  • Review of HCBS Final Rule
  • Scheduling and Requesting Documentation
  • During the SADC Compliance Review Process
  • Post-SADC HCBS Compliance Review Activities
  • Remediation Plan Request and Handling
  • Proof of Remediation Handling

Please note: MLTC Plan SADC Contracting and Oversight: Roles and Responsibilities will be added to the SADC HCBS Compliance website soon.

SADC programs should also note the new suggested SADC Site Evaluation Tool for MLTC plans recently updated on the site.
