DOH Holds Webinar for MLTC Plans Regarding SADC HCBS Compliance

(Dec. 17, 2024) The Department of Health (DOH) held a webinar for Managed Long Term Care (MLTC) plans on Dec. 10, 2024 outlining compliance activities required by plans to ensure that social adult day care (SADC) programs under contract are in full compliance with the federal Home and Community-Based Services (HCBS) Settings Rule. 

The webinar provided an overview of the following:

  1. MLTC plan resources for HCBS compliance activities;
  2. HCBS compliance review process;
  3. Trends from Calendar Year (CY) 2024 reviews and best practices;
  4. Updates to HCBS compliance review questions for CY 2025; and
  5. New resources available for CY 2025.

The webinar and slides shared the resources and responsibilities plans must have in place to ensure that contracting SADCs demonstrate compliance. DOH review of all SADCs will occur on an annual basis and may not be scheduled with the same MLTC plan each year. Details include scheduling and requesting of supporting documentation; preparation for the review; steps in the review process, which is expected to take two hours; and remediation steps if required, including proof of remediation.

The webinar also included concerning trends regarding community integration and identified proper implementation of this practice, including documentation of offering various options to participants. Other concerns were communicated by the Department regarding privacy; freedom to choose activities, meals, and staff, if available; as well as opportunities for individual initiative and autonomy.
