Input Needed on ACF/AL Regulatory Reform Issues

LeadingAge NY is continuing work with the Department of Health (DOH) and other stakeholders on regulatory reform for Adult Care Facility (ACF) and Assisted Living (AL) regulations. The group is meeting on a regular basis and will routinely reach out to the membership on certain issues that are being considered. In addition, there is an internal workgroup that informs the association's input in the larger stakeholder group.

One of the issues that LeadingAge NY has been advocating for is to extend the amount of time providers have to settle a resident’s account when a resident leaves the facility or passes for private pay residents. Currently, the operator has three days to return any funds to the resident or resident representative.

DOH would like to better understand:

  • specifically, the circumstances why it may take more time; and,
  • what would be a sufficient amount of time to enable an accurate settling of the account?
