Important Updates for ACFs Regarding HCBS Compliance Assessment

(Dec. 16, 2024) On Fri., Dec. 13th, the Department of Health (DOH) presented a webinar on the Home and Community-Based Services (HCBS) Final Rule Compliance Training for adult care facilities (ACFs). DOH would like providers to let them know they participated in the presentation by emailing ACFHCBS@health.ny.gov and including the ACF name and the name and title of each person viewing the presentation. Click here for background on this issue.

As a reminder, all ACF and assisted living providers must complete the survey; however, those who do not have any residents with active Medicaid can complete the attestation in question one and submit the survey. All others must complete the survey in its entirety.

DOH clarified that the due dates are

  • Jan. 7, 2025 by close of business for assisted living programs (ALPs).
  • Jan. 16, 2025 by close of business for all other ACF and assisted living providers.

LeadingAge NY pushed for an extension to these due dates, but DOH is not willing to provide an extension at this time.

It is important to note that DOH has updated the link to the Drupal survey given that there were upload requests in the survey that should not have been there. Members should use this link moving forward. Remember that you are not able to save your work in the survey and return to it at another time. Thus, you are advised to use this PDF copy of the survey to compile the necessary documentation and then clear room in your schedule to complete the full survey.
