How the Justice Center Affects All ACFs
The New York State Justice Center for the Protection of People with Special Needs became operational on June 30, 2013. The Justice Center will affect providers in different ways. First, any reporting that any ACF provided to CQCAPD will now be reported to the Justice Center. Click here for more information.
Secondly, ACFs under the jurisdiction of both DOH and the Justice Center will have to follow certain requirements. The Justice Center has oversight over adult homes and enriched housing programs with 80 beds or more in which 25 percent or more of the residents have a serious mental illness. If the program has ALP licensure, only facilities that meet the aforementioned criteria and have fewer than 55 percent of their beds designated for the ALP are under the jurisdiction of the Justice Center.

It should be noted that DOH uses the most recent data for the annual statistical report to determine which facilities should be under the jurisdiction of the Justice Center. Thus, the status of a particular facility can change, depending on the composition of the facility over time.
