DOH Announces Intent to Amend Regulations for HCBS Settings Rule Compliance

The Department of Health (DOH) issued a Dear Administrator Letter (DAL) on July 5th announcing plans to issue proposed regulation changes in the near future for all adult care facilities (ACFs). The regulation changes are intended to assist with compliance with the federal Home and Community-Based Services (HCBS) Settings Rule. As LeadingAge NY has reported, we anticipated that the Department would revise some regulations for this purpose. The proposed regulations for this and other anticipated regulation changes noted by DOH, such as changes to comply with a law to collect information regarding veteran status, changes to the quality assurance process, and updates to assisted living residence (ALR) regulations, are not yet available. Once DOH publishes these regulations, LeadingAge NY will analyze them and provide comment based on member feedback.
