DEC Offering Webinar on NYS Food Donation and Food Scraps Recycling Law
On Sept. 16, 2020 from 1:30 to 2:30 p.m., the New York State Department of Environmental Conservation (DEC) will be hosting a free webinar providing updates on the New York State Food Donation and Food Scraps Recycling law. They will be joined by the New York State Pollution Prevention Institute, who will provide an overview of their services and give an exciting announcement on upcoming available funding for organics diversion. In 2019, New York State passed the Food Donation and Food Scraps Recycling law. Effective Jan. 1, 2022, businesses that generate two tons of wasted food and food scraps per week or more must donate their excess edible food and recycle all remaining food scraps if they are within 25 miles of a food scraps recycler (e.g., composter, anaerobic digester).
Examples of businesses that may be subject to this law include grocery stores, restaurants, colleges, hotels, malls, zoos, airports, sports arenas, and event venues. In response to LeadingAge NY advocacy, nursing homes and adult care facilities (ACFs) are exempt from this law, in addition to New York City businesses (which are subject to a local law), hospitals, and K-12 schools.
