CMS Seeks More Detail on HCBS Settings Transition Plan
The Centers for Medicare and Medicaid Services (CMS) has responded to New York’s proposed transition plan to ensure compliance with the federal Home and Community Based Settings (HCBS) rule. The response, which can be viewed here, essentially asks the State for more detail regarding the plan, and the process by which they elicited public feedback. CMS is also interested in understanding how the State plans to conduct assessments of settings that meet the heightened scrutiny standard; that is, settings that are on the same campus, adjacent to, or under the same roof as an institution. CMS also wants the State to look at those individuals served under the 1115 waiver, which authorizes the enrollment into managed care and managed long term care. While this requirement does not yet apply to those services, CMS notes that it will. Ultimately, the State must re-isuse the plan for public comment. We will alert members when the plan is posted again.
