DOH Releases 2022 ACF Financial Report
The Department of Health (DOH) has posted a Dear Administrator Letter (DAL) announcing the availability of the 2022 Adult Care Facility (ACF) Financial Report on the Health Commerce System (HCS). Please note that the DAL was originally posted on Dec. 8, 2023, but was revised on Dec. 11, 2023.
All ACFs that have been in operation for six months or more during calendar year 2022, as well as ACFs that underwent a change of operator between related ACFs during calendar year 2022, must submit the report. In addition, the ACF Certified Public Accountant (CPA) Certification must be completed by all ACFs with 26 beds or more; see Enclosures II and III and use that which is appropriate for the facility. LeadingAge NY, together with other stakeholders, once again requested that DOH reconsider the requirement of an audited, rather than reviewed, annual financial statement for ACFs. This requirement appears unchanged, however.
The Certification of Operation statement (DOH-5780) must also be completed and submitted by all ACFs.
The deadline for submission of the 2022 ACF Annual Financial Report and the relevant certifications follows:
For ACFs using a calendar year as their fiscal year, the due date is May 31, 2024. ACFs using a fiscal year period that differs from a calendar year are required to file their report by the 15th day of the sixth calendar month following the close of their fiscal year. If this falls before May 31, 2024, then the due date is May 31, 2024.
See the DAL for information regarding how to find the report on the HCS, as well as details regarding submission of the report. The ACF Annual Financial Report Companion Guide (Enclosure I) provides guidance regarding the completion of the report. Questions can be directed to DOH at acffinrpt@health.ny.gov.
