DOH Issues DAL to ACFs Regarding Fair Housing and Admission and Retention Standards

On April 25, 2023, the Department of Health (DOH) issued a Dear Administrator Letter (DAL) to adult care facilities (ACFs) with attachments regarding admission and retention regulations and Fair Housing.

As noted in the DAL, the Department will hold a webinar on the DAL on May 4, 2023 at 2 p.m., during which the Department will offer further guidance. To register, click here.

Members should note that our counsel at Hinman Straub will be doing a session on the changes in admission and retention standards and compliance with federal law including Fair Housing and the Americans with Disabilities Act at our upcoming Annual Conference in May. Kelly Ann Anderson, the new DOH Director of the Division of ACF/Assisted Living (AL) Surveillance, is also presenting. These will be great opportunities to get more information regarding this guidance.
