LeadingAge NY Submits Comments on Advanced Home Health Aide and CHRC Regulations
LeadingAge NY submitted comments on the regulatory proposal from the Department of Health (DOH) regarding advanced home health aides (AHHAs) and criminal history record checks (CHRCs) for adult care facilities (ACFs) and hospice providers. Our comments focused primarily on the implementation of the AHHA and what it means for supervision and responsibilities for the provider. In addition, we advocated for the Assisted Living Program (ALP) to be able to use the AHHA and sought clarification regarding the implications for aides working in the Assisted Living Residence (ALR), Enhanced Assisted Living Residence (EALR), and Special Needs Assisted Living Residence (SNALR). Additional emergency regulations were issued by the State Education Department (SED), and we will have the opportunity to submit comments on those regulations as well. The SED and DOH regulations were developed collaboratively, and thus there is a great deal of consistency. That being said, it is recommended that home care, assisted living, hospice, and managed long term care (MLTC) members review the regulations and let us know of any concerns or recommended changes to the SED emergency regulations.
