LeadingAge NY opposes this legislation, which amends the Public Health Law to impose minimum daily hours requirements for nurses and certified nurse aides in nursing homes.  

This bill amends provisions of law enacted through Chapter 89 of 2021. LeadingAge New York’s members share the concerns the underlying legislation seeks to address. However, we have additional concerns regarding this bill's provision for the adoption of regulations on an emergency basis without the opportunity for public input and comment. 

LeadingAge New York opposes this legislation which would require the Department of Health (DOH) to establish and implement an infection control competency audit, establish infection control competency standards, and require implementation of a checklist for residential care facilities nursing homes. 

LeadingAge New York has concerns about this legislation, which could impede the consolidation of not-for-profit entities and delay necessary staffing contracts.  

LeadingAge NY opposes this legislation, which would establish a resident care spending ratio for nursing home expenditures, requiring at least 70 percent of operating revenue to be spent on resident care.

LeadingAge NY has concerns about this bill, which would create new requirements for the Department of Health (DOH) and nursing homes in the context of a disaster emergency that involves a disease outbreak.  

LeadingAge NY Supports this legislation which would modify Article 2 of the Public Housing Law to require the development of a five-year capital spending plan as part of the annual executive budget.

LeadingAge NY opposes this legislation, which would establish a “direct patient care ratio” for nursing home expenditures, requiring at least 70 percent of the aggregate revenue to be spent on direct care of residents and at least 40 percent on staff wages and benefits and contracted or purchased staffing services. Eighty-five percent of the amount spent on contracted staff would be counted as direct care expenditures.
