If signed into law by Governor Andrew Cuomo, the measure will modify current Medicaid regulations and payment policy that prevent terminally ill residents of Assisted Living Programs from accessing hospice services.

Action serves as a means to create “thriving communities” across New York that “support and attract people of all ages” and further maximize its efforts as the first age-friendly state in the country.

A lawsuit filed by LeadingAge New York and the Empire State Association of Assisted Living in State Supreme Court, Albany County, seeks to hold Governor Cuomo and top agency officials accountable to meet their constitutional and statutory obligations by requiring them to increase funding for the State Supplement Program to meet adult care facilities’ actual costs.
