Nursing Home Admission of Sex Offenders

Hinman Straub, LeadingAge NY's counsel, has provided some important guidance for nursing home members around the issue of the admission and care of registered sex offenders. A number of members had sought guidance as a result of either being asked to admit an individual appearing on the New York State Registry or finding out, after admission, that an individual was on the Registry. The memorandum from Hinman Straub reflects on both federal and state statutes and regulations and provides information on notification, facility obligations, and policy considerations.
