Revisions Made to Adult Day Health Care Part 425 Regulations

The Adult Day Health Care Council (ADHCC) held a webinar last week to review revisions made to Part 425 regulations governing adult day health care (ADHC).

Revisions generally relate to the following:

  • Inclusion of the Home and Community-Based Services (HCBS) Settings Rule in Part 425, including person-centered planning, references to community-based care, registrants' rights, and community integration;
  • Some changes to referral and authorizing entities;
  • Changes regarding the unbundled services payment option;
  • Possible changes to nursing services definition; and
  • Removal of requirement to consider on-site establishment of programs.

ADHCC is waiting to hear back from the Department of Health (DOH) on several questions pertaining to the revisions, and we will share the Department’s interpretations. The PowerPoint presentation is available here, and the recording is here.

The amended regulations which show the new changes are available here. The finalized version of the regulations which incorporates the new changes but does not identify them is here.
