DOH Issues 2025 Questionnaire and Attestation for ADHC Programs

(Feb. 10, 2026) The Department of Health (DOH) issued a Dear Administrator Letter (DAL) to Adult Day Health Care (ADHC) programs on Feb. 9th issuing an updated questionnaire and attestation for ADHC programs to complete for each program they operate.

The updated survey largely mirrors ADHC's annual Program Survey Report and includes new questions assessing Home and Community-Based Services (HCBS) Final Rule compliance. It is based on Title 10 of NY Codes, Rules, and Regulations, Part 425, and the federal HCBS Final Rule at Title 42 of the Code of Federal Regulations, Section 441.530, and is used by DOH as a resource to determine and document regulatory compliance.

The web-based survey must be completed by the ADHC program based on information from the previous calendar year (2025) and will be deployed annually. The Department will review the survey and conduct unannounced onsite visits to verify the accuracy of the survey responses.

The calendar year 2025 completed survey must be submitted, including the attestation component, within 30 days of receipt of the notice.
