NY Has Another Year to Develop Transition Plan for HCBS Settings Rule
LeadingAge NY learned that New York has more time to draft a plan to implement the federal home and community based settings rule. One of the factors that helps determine when the new requirements are effective is the time at which the State requests a federal waiver or the renewal of an existing waiver. New York decided to rescind a waiver request for the population served by the Office People With Developmental Disabilities (OPWDD), thus providing the State another year to work on their transition plan.
DOH is reportedly reviewing the comments submitted on the initial plan, and will revise it for another public comment opportunity this winter. The State will then have five years to come in compliance with the regulations. LeadingAge NY has submitted comments on the initial transition plan, which can be viewed here. We are pleased that the State has more time to implement this complex rule, and will take advantage of the additional opportunity for public comment, when available.
